A patent attorney who is guilty of any act or omission which is contrary to the care which he/she should exercise with respect to those whose interests he/she is or should be representing, which is contrary to the byelaws or articles of the institute or which is contrary to conduct that befits a patent attorney can be subjected to the following measures by the supervisory council, without diminishing his/her liability under other legal provisions.
The supervisory council can impose one of the following measures on the patent attorney, if it believes that a complaint brought against a patent attorney is justified:
a. warning;
b. reprimand;
c. suspension of the right to act as a patent attorney for the agency for a period of up to five years;
d. disqualification from the right to act as a patent attorney at the Netherlands Patent Office.
The Supervisory Council will consider a complaint brought against a patent attorney on the basis of a reasoned notice of complaint submitted to it in writing. You can send your complaint to

The supervisory council will not consider a complaint if the incident to which the complaint relates took place more than five years prior to the submission of the complaint.
The chairman of the council can summarily reject the complaint by means of a reasoned ruling after a brief investigation, where necessary after having heard the complainant and the patent attorney concerned, if he/she believes that it is manifestly inadmissible, manifestly ungrounded or of insufficient weight.
If you have a problem with a patent attorney which you cannot reasonably resolve together, you can submit a written complaint with reasons to the Supervisory Council.
